Terms and Conditions

Please read these Terms and Conditions carefully before using the Home Workers platform. By registering an account or using any part of our service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the platform.


1. Definitions

  • "Platform" means the Home Workers website and all associated services accessible at homeworkers.co.za.
  • "We", "Us", "Our" refers to Bruton IT Solutions (Pty) Ltd, the owner and operator of the Platform.
  • "You", "User" refers to any individual or entity that registers for or uses the Platform.
  • "Employer" means a User who employs one or more domestic workers and uses the Platform to manage compliance obligations.
  • "Worker" means a domestic worker (housekeeper, gardener, caregiver, or similar) whose details are captured on the Platform by an Employer.
  • "Services" means all features offered by the Platform, including but not limited to employment contract generation, COIDA registration assistance, payment record keeping, and access to our AI labour consultant.

2. Description of Service

Home Workers is an online compliance management platform designed to assist South African household employers in meeting their legal obligations under applicable labour legislation, including but not limited to:

  • The Basic Conditions of Employment Act (BCEA), Act 75 of 1997
  • The Compensation for Occupational Injuries and Diseases Act (COIDA), Act 130 of 1993, as amended to include domestic workers
  • The Unemployment Insurance Act (UIA), Act 63 of 2001
  • The National Minimum Wage Act, Act 9 of 2018
  • Sectoral Determination 7 for Domestic Workers

The Platform assists with compliance guidance and document generation. It does not constitute legal advice. For specific legal matters, you should consult a qualified labour law attorney.


3. Eligibility and Registration

To use the Platform you must:

  • Be at least 18 years of age.
  • Be a South African resident or employer of domestic workers in South Africa.
  • Provide accurate, current, and complete information during registration and keep it up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at info@homeworkers.co.za if you suspect any unauthorised use of your account.


4. Subscription Plans and Payments

Access to certain features of the Platform requires a paid subscription. By subscribing, you agree to the following:

  • Subscription fees are charged monthly or annually as selected at the time of purchase.
  • All prices are quoted in South African Rand (ZAR) and are inclusive of VAT where applicable.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for the unused portion of a billing period.
  • We reserve the right to change subscription pricing on 30 days' written notice via email.

The Free tier is provided as-is and may be modified or discontinued at any time without notice.


5. Acceptable Use

You agree not to use the Platform to:

  • Submit false, inaccurate, or misleading information about yourself, your workers, or your employment arrangements.
  • Violate any applicable South African law or regulation.
  • Attempt to gain unauthorised access to any part of the Platform or its systems.
  • Transmit any malicious code, virus, or other harmful software.
  • Reproduce, redistribute, or resell any part of the Platform or its content without our written consent.
  • Use the Platform on behalf of third parties without their consent and without disclosing this to us.

We reserve the right to suspend or terminate accounts found to be in violation of these provisions.


6. Intellectual Property

All content on the Platform, including but not limited to software, text, graphics, logos, document templates, and the AI labour consultant, is the intellectual property of Bruton IT Solutions (Pty) Ltd or its licensors and is protected under South African and international copyright law.

You are granted a limited, non-exclusive, non-transferable licence to use the Platform for its intended purposes. This licence does not include the right to copy, modify, distribute, sell, or create derivative works from any part of the Platform.

Documents generated by the Platform (such as employment contracts) for your specific use remain your property; however, the underlying templates remain ours.


7. Accuracy of Information

While we make every effort to keep the information on the Platform accurate and up to date with current legislation, we cannot guarantee that all information is complete, current, or free from error. South African labour legislation changes regularly.

The Platform provides compliance guidance and should not be relied upon as the sole source of legal advice. We strongly recommend that you verify critical compliance requirements directly with the Department of Employment and Labour or a qualified legal professional.


8. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by South African law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.


9. Limitation of Liability

To the maximum extent permitted by law, Bruton IT Solutions (Pty) Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, including but not limited to:

  • Fines or penalties imposed by the Department of Employment and Labour or any other government body.
  • Losses arising from reliance on documents generated by the Platform.
  • Loss of data, revenue, or profits.

Our total aggregate liability to you shall not exceed the subscription fees paid by you in the 12 months preceding the event giving rise to the claim.


10. Indemnification

You agree to indemnify and hold harmless Bruton IT Solutions (Pty) Ltd, its directors, employees, and agents from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of the Platform, your breach of these Terms, or your violation of any applicable law or the rights of a third party.


11. Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, if:

  • You breach these Terms.
  • We are required to do so by law.
  • We decide to discontinue the Platform.

Upon termination, your right to use the Platform ceases immediately. You may request a copy of your data within 30 days of termination; thereafter we may delete your records in accordance with our data retention policy.


12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of South Africa.


13. Dispute Resolution

In the event of a dispute, we encourage you to contact us first at info@homeworkers.co.za to resolve the matter amicably. If no resolution is reached within 30 days, either party may refer the matter to the relevant South African court of competent jurisdiction.


14. Changes to These Terms

We reserve the right to update these Terms at any time. Where changes are material, we will notify registered users by email at least 14 days before the changes take effect. Your continued use of the Platform after the effective date constitutes your acceptance of the revised Terms.
